تحلیل رویکردهای دولت میزبان و نهاد داوری در برخورد با نقض حقوق بشر توسط سرمایه‌گذار خارجی

چکیده
همزمان با فرا رسیدن عصر جهانی شدن، مسئله جذب سرمایه‌گذار خارجی به یک میدان رقابت برای بسیاری از کشورها مبدل شد. در این میان، برخی از کشورها با هدف جذب بیشتر سرمایه‌گذار خارجی به اتخاذ راهکارهایی غیرمعقول همچون سکوت عامدانه در خصوص تعهدات سرمایه‌گذار مبنی بر لزوم احترام به حقوق بشر روی آورده و حتی قدرت تنظیم‌گری خود در این راستا را محدود یا خنثی نمودند. حال و با توجه به اهمیت یافتن حمایت، احترام و تحقق حقوق بشر توسط دولت‌ها در دنیای امروز، پرسش اصلی تحقیق حاضر آن است که چنانچه قرارداد سرمایه‌گذاری در خصوص تعهدات سرمایه‌گذار خارجی مبنی بر لزوم احترام به حقوق بشر مسکوت باشد و سرمایه‌گذار خارجی در حین اجرای پروژه سرمایه‌گذاری استانداردهای حقوق بشری را نقض کند، دولت میزبان چه رویکردهایی را در برابر او اتخاذ نموده و حَسب آن رویکردها، موضع نهاد داوری به عنوان مرجع حل‌وفصل اختلافات سرمایه‌گذاری به چه صورت خواهد بود؟ نویسندگان با هدف یافتن پاسخی معقول و استدلال‌محور برای پرسش اخیر از روش توصیفی-تحلیلی استفاده نموده‌اند. نتایج کلی تحقیق ضمن شناسایی سه رویکرد که ممکن است از جانب دولت میزبان در برابر سرمایه‌گذار خارجی اتخاذ شود به این واقعیت اشاره می‌کند که نهاد داوری بستر لازم برای اتخاذ دو رویکرد خنثی و یا ایجابی را دارا بوده که اتخاذ هر یک از دو رویکرد اخیر مغایر با اصول داوری ترافعی نیست. با این حال اتخاذ رویکرد خنثی چالش‌های زیادی در پی خواهد داشت و اتخاذ رویکرد ایجابی ملاحظات چندگانه‌ای را می‌طلبد.

Analysis of the Approaches of the Host State and the Arbitration Institution in Dealing with Human Rights Violations by Foreign Investors

چکیده English

With the advent of the era of globalization, the issue of attracting foreign investors has become a competitive field for many countries. In the meantime, some countries, with the aim of attracting more foreign investors, have resorted to adopting unreasonable solutions such as deliberate silence regarding the investor's obligations regarding the need to respect human rights and have even limited or neutralized their regulatory power in this regard. Now, considering the importance of protecting, respecting, and realizing human rights by governments in today's world, the main question of the present study is that if the investment contract is silent regarding the foreign investor's obligations regarding the need to respect human rights and the foreign investor violates human rights standards while implementing the investment project, what approaches will the host state adopt towards him and, based on those approaches, what will be the position of the arbitration institution as a reference for resolving investment disputes? The authors have used a descriptive-analytical method in order to find a reasonable and argumentative answer for latter question. The overall results of the study, while identifying three approaches that may be adopted by the host state against a foreign investor, point to the fact that the arbitral institution has the necessary basis for adopting two neutral or positive approaches, and the adoption of either of the latter two approaches is not contrary to the principles of adversarial arbitration. However, adopting a neutral approach will entail many challenges, and adopting a positive approach requires multiple considerations.
