راهکارهای ایران برای دریافت غرامت جنگی از عراق

چکیده
با گذشت حدود سه دهه از پایان جنگ تحمیلی عراق علیه ایران، هنوز مساله دریافت غرامت جنگی ایران از عراق در‌هاله‌ای از ابهام قرار دارد. هدف این مقاله پاسخ به این پرسش می‌باشد که ایران چه راهکارهایی برای دریافت غرامت جنگی از عراق دارد؟ در پاسخ به سئوال فوق می‌توان سه راهکار سیاسی-حقوقی متصور شد که عبارتنداز: 1) ایران می‌تواند در چارچوب حل و فصل مسالمت‌‌آمیز اختلافات، با مقامات دولت عراق مذاکره مستقیم دوجانبه انجام دهد؛2) ایران می‌تواند با استناد به گزارش دبیرکل وقت سازمان ملل درخصوص مسئولیت عراق درشروع جنگ، به شورای امنیت مراجعه و خوهان تصویب قطعنامه‌ای مبنی بر ملزم کردن عراق به پرداخت غرامت به ایران، شود؛ 3) ایران می‌تواند در چارچوب رسیدگی قضایی و به موجب اساسنامه دیوان بین‌المللی دادگستری، در این دیوان علیه عراق طرح دعوی کند. فرضیه تحقیق این است که در حال حاضر ایران نمی‌تواند از عراق غرامت جنگ را دریافت نماید. برای اثبات این فرضیه راهکارهای سه گانه فوق به آزمون گذاشته خواهند شد تا میزان امکان اجرایی شدن هریک مشخص گردد.

Iran Solutions for receiving war damage from Iraq

After nearly three decades of war between Iran and Iraq, Iran’s war damage demanding from Iraq is still in doubt. The purpose of this article is to answer this question: what strategies Iran has to demanding war damage from Iraq?
To answer this question we have three political-legal strategies: 1) Iran could move in the framework of the peaceful settlement of disputes with Iraqi authorities and through direct bilateral negotiations reaches the war damage. 2) Iran could - according to the report of the Secretary General of the United Nations based on Iraq responsibility to start the war - referred to the Security Council and called for resolution to obligate Iraq to pay damage. 3) Iran - according to the Statute of the International Court of Justice - could lawsuit against Iraq in the International Court of Justice. The research hypothesis is that Iran can not receive war damage from Iraq currently. To prove this hypothesis, the above-mentioned strategies will be examine to determine the possibility of implementing each.
