چکیده

آموزش و حق بر سلامت و بهداشت عمومی موضوعات به هم پیوسته‌ای هستند که یکی بدون دیگری قابل تصور نخواهد بود. به موجب ماده 14 پیمان‌نامه حقوق اقتصادی، اجتماعی و فرهنگی؛ دولت‌ها متعهد شده‌اند تدابیر لازم را پیرامون اجرای کامل آموزش حقوق بشر اتخاذ نمایند و در صورت عدم اجراء، مرتکب نقض تعهد بین اللمللی خواهند شد. از اینرو با عنایت به اهمیّت و جایگاه آموزش در نظام بین الملل حقوق بشر می‌توان چنین اذعان نمود که بهره‌مندی از سایر حقوق بنیادین بشری نظیر حق بر سلامت و بهداشت عمومی در برخورداری از آموزش حقوق بشر امکان‌پذیر خواهد بود. پژوهش حاضر بصورت یک مطالعه موردی انجام شده و هدف از نگارش آن تبیین مفهوم و ابعاد تحت پوشش آموزش حقوق بشر در حوزه سلامت و بهداشت عمومی می‌باشد.
سوال اصلی که این پژوهش به دنبال پاسخ به آن است، این امر است که با توجه به تحولات اخیر، در فرآیند ورود این حق به نظام بین‌المللی حقوق بشر، رویکرد دولت‌ها در ارتباط با حق مزبور باید حق محور باشد یا درمان محور؟ فرضیه ما حاکی از آنست که رویکرد دولت‌ها در خصوص سلامت و بهداشت عمومی و آموزش آن، حق محور می‌باشد. لذا عدم توجه به آموزش سلامت و بهداشت عمومی می‌تواند منجر به آسیب‌های شدید اجتماعی در جوامع انسانی شود. بنابر این، دولت‌ها بایستی با بهره‌گیری از همکاری های بین‌المللی، ظرفیت های اجرایی خود را جهت بهره مندی افراد جوامع از چنین حقی افزایش دهند. روش انجام پژوهش به شیوه توصیفی ـ تحلیلی با گردآوری منابع است.

چکیده [English]

Education and the right to health and public health are interrelated topics that one cannot be imagined without the other. Under Article 14 of economic, social and cultural rights states are committed to take necessary measures to fully implement human rights education and if not implemented, would be committed in breaching of international obligations. So, given the importance and place of education in international human rights system, it can be acknowledged that enjoyment of other fundamental human rights, such as the right to public health, would be possible in the fruition of human rights education. This research is a case study and its purpose is to explain the concept and dimensions covered by human rights education in the field of public health.
The main question this study seeks to answer in light of recent developments in the process of the entry of this right into the international human rights, is that the states approach to this right should be right-centered or treatment-centered? Our hypothesis is that governments approach to public health and education is right-centered. Therefore, failure to pay attention to public health education can lead to severe social harm in human societies. Therefore governments should increase their executive capacity to benefit individuals in societies by using international cooperation. The method of this research is descriptive-analytical with the collection of resources.
