چکیده
در زمینه مطالعات برابری، نظریه راهبردی برابری فرصت‌ها با وجود ادبیات گسترده فلسفی و حقوق بشری، در رابطه با فقه توسعه نیافته است، به ویژه با سه‌گانه برابری یعنی: ثروت، قدرت و دانش. البته چندین مدل مفهومی برای سازماندهی نظریه برابری فرصت در سطوح اقتصادی، سیاسی و فرهنگی با فقه شکل گرفته است، اما به دلیل اختلاف در مبانی معرفت‌شناختی بین ساختارهای لیبرال دموکراسی و مردمسالاری دینی، کثرت‌گرایی معرفت شناختی لیبرال و انحصاری‌گرایی دینی، اقتصاد بازار آزاد و اقتصاد فقهی شکل گرفته است. با این حال این مدل‌ها به دلیل مذکور زمینه عقاید و عمل، به سردرگمی عوامل و التقاط اندیشه‌های غربی و اندیشه‌های بومی در ایران منجر شده است. تحلیل برخی از جنبه‌های این وضعیت پیچیده، هدف این مقاله است که موضوع را از منظر فقه و حقوق بشر بازتعریف خواهد کرد.. این مقاله تلاش دارد به این سوال پاسخ دهد که با مدنظر قرار دادن نظریه برابری سرانجام مشارکت سیاسی مؤثر شهروندان در حوزه قدرت چه خواهد بود؟و در زمینه رفاه، برای بهبود وضعیت افراد کمتر برخودار چه بایدکرد و نیز در زمینه دانش و فرهنگ، رقابت آزاد بین عقاید و اندیشه‌ها با توجه به اصل برابری فرصت‌ها در محیطی عاری از خشونت و تحریف، و عاری از تحمیل و ممیزی و تک‌صدایی موجود در سیاست چه خواهد بود؟

چکیده English

In the field of equality Study, the strategic theory of equality of opportunity is that despite the extensive philosophical literature and human rights in this topic, its relationship in jurisprudence with the triple of wealth, power and knowledge has not been much refined and developed. Several conceptual models for organizing equality of opportunity in the levels of economics, politics and culture have been formed due to differences in epistemological foundations between the structures of liberal democracy-religious Democracy, epistemological pluralism- exclusivism, free market economy-jurisprudential economy, in The context of opinion and practice has led to the confusion of agents and the eclecticism of indigenous ideas and Thoughts. An analysis of some aspects of this complex situation is the task of this article, which redefines the issue from the perspective of jurisprudence and human rights. Finally, what should be the plan to provide effective political participation of citizens in the field of power? And in the field of welfare, to improve the situation of less privileged people, and finally in the field of knowledge and culture, free competition between ideas and thinks in the light of the principle of equality of opportunity and in an environment free of violence, distortion, imposition, auditing and Monologue.
