Growth, progress and development are inevitable destiny of the countries in the international system. In the process of the modernization of the countries of the world, there are several waves. In every wave of development, some of the countries have able to endeavor to developed situation. The occurring of the new wave of the modernization of the certain countries, misfortunately, became simultaneous with the happening of the triumph of the Islamic Revolution and the Iran-Iraq war. So, Iran was left behind of the caravan of the developed and developing countries. Author, in this paper, tries to discuss the idea about the role and status of the develop-maker capacities in the constitutions. This belief maybe contradiction with the idea of the rule of law.
