عدالت ترمیمی و ظرفیت‌سازی مبارزه با تروریسم در اروپا

چکیده
مبارزه با تروریسم از مهم‌ترین مسائل امنیتی اروپا است و رویکرد اولیه کشورهای اروپایی بر عدالت کیفری و جرم‌انگاری ابعاد مختلف تروریسم استوار است درحالی که در گرایش به گروه‌های تروریستی، زمینه‌های اجتماعی و فردی نقش عمده‌ای دارند، لذا از بین بردن این زمینه‌ها مهم تلقی می‌شود. عدالت ترمیمی برای برآوردن این مقصود، رویکرد متفاوتی را پیش‌روی تصمیم‌سازان نهاده است. پرسش این پژوهش این است که چگونه عدالت ترمیمی بر مبارزه با تروریسم در اروپا تاثیر گذاشته است؟ پژوهش حاضر با استفاده از نظریه اجتماع مبتنی بر رویه و کاربست روش تبینی ـ تکوینی و با هدف یاری رساندن به سیاست‌گذاران امنیتی کشور در زمینه مقابله با تروریسم انجام شده است. نتایج پژوهش از طریق واکاوی تجربه کشورهای اروپایی نشان می‌دهد که عدالت ترمیمی از طریق بازاندیشی در تعریف هویت فردی و اجتماعی در مبارزه با تروریسم مؤثر بوده و می‌تواند موجد صلح اجتماعی گردد. این بازاندیشی موجب می‌شود فرد در هویت تروریستی خود تجدیدنظر نماید و در نتیجه بسترهای صلح اجتماعی به وجود ‌آید. تأیید دوباره ارزش‌های جامعه و تقبیح رفتار مجرمانه در نتیجه عدالت ترمیمی در کاهش به حاشیه رانده شدن افراد در مبارزه با افراط‌گرایی و بازگشت آن‌ها به جامعه تاثیر بسزایی دارد.

چکیده English

European countries primarily address terrorism, a significant security concern, through criminal justice mechanisms and the criminalization of various terrorist activities. However, it is imperative to address the substantial influence of both social and individual factors on the formation and proliferation of terrorist groups. Restorative justice offers decision-makers an alternative strategy to achieve this goal. The main question of this research is: How has restorative justice influenced the fight against terrorism in Europe? This study applied the principles of community of practice theory and the explanatory-constructive method to assist Iranian security policymakers in their efforts to combat terrorism. An analysis of prior experiences in European countries demonstrates that restorative justice is effective in combating terrorism and can promote social peace by redefining individual and social identities. This redefinition encourages individuals to reconsider their terrorist identity, thereby laying the foundation for social peace. Restorative justice enables society to combat extremism effectively and reintegrate individuals by reinforcing societal values and denouncing criminal behavior. This approach is crucial in reducing marginalization and facilitating successful reintegration into society.
