Abstract
The protection of diverse cultures against various threats- such as integration, transmutation, and culture hegemony are among the unpleasant consequences of globalization- is one of the priorities of UNESCO. The ratification of the Convention on the Protection and Conservation of Cultural Diversity 2005 confirms this claim. Based on pre-studies on the subject, the authors examine the hypothesis of this paper, which is "The protection of cultural diversity requires recognition of cultural pluralism, which is actualized through the development of cultures and interaction among them; and its actual value is shown in cultural diversity and the true unity of humans." Since achieving human rights is not possible without emphasis on cultural capacities, this question is introduced on how we can redefine legal rules, institutions, and mechanisms to improve cultural rights, so that in relativism era, double standards and cultural hegemony this process results in reinforcement of common values of humans, guarantee of fundamental rights, and cohesion and solidification of international human rights law. Finally, this paper tries to study the relationship between human rights and cultural rights dichotomy by systemic and interdisciplinary methodology.
