Both elements are essential for the advancement of affairs and goals of the political community. If there is no power, there is chaos and disorder, and if there is no freedom, there is death. According to Jean-Jacques Rousseau, the power of evil is necessary. On the one hand, to preserve the order of human liberties, the existence of a state of authority is necessary, and on the other hand, the government, under the pretext of maintaining order, may threaten the legitimate liberties of the nation; therefore, there should be a balance between the authority of the state and the protection of the rights of citizens. This article is descriptive-analytical and based on the rights of citizens against the authority of the state, referring to the constitution as the turning point of the balance between power and freedom در هر جامعه سیاسی دو عنصر ناهمسان و متعارض در کنار یکدیگر قرار دارند که عبارتند از: قدرت و آزادی. وجود هردوی این عناصر برای پیشبرد امور و اهداف جامعه سیاسی ضروری است. اگر قدرت وجود نداشته نباشد هرج و مرج و بی نظمی است و اگر آزادی وجود نداشته نباشد مرگ است. به گفته ژان ژاک روسو قدرت شر لازم است، از یکسو برای حفظ نظم وانتظام آزادی‌های انسان، وجود دولت صاحب‌اقتدار ضروری است، از سویی دیگر امکان دارد دولت به بهانه حفظ نظم، آزادی‌های مشروع ملت را در معرض تهدید قرار دهد؛ و از اقتدار خود سو استفاده نماید. بنابراین، باید تعادلی بین اقتدار دولت و حفظ حقوق شهروندان ایجاد کرد، این مقاله به روش توصیفی – تحلیلی و با مبنا قرار دادن حقوق شهروندان در برابر اقتدار دولت، با مراجعه به قانون اساسی به‌عنوان نقطه عطف تعادل بین قدرت و آزادی می‌پردازد. https://www.isjq.ir/article_89833_5d4657c1a25a62de4725947380cf8884.pdf
