Limitations and ambiguities of the natural language in formulation of legal concepts and explanation of realities and values of international law cause the publicist to exceed the real boundaries of law knowledge. Therefore, in a context of logics, linguistics, and linguistic analytic philosophy, the publicist presents concepts, propositions, texts, rationalism models, and legal theories and attempts to recognize nature, type, and rational implications of them. This means that legal language must have phenomenal expressiveness capacity, exploration of meaning and decoding of legal texts for the exact description of realities and facts of collective life and should also represent and codify legal necessities and values. Legal language that is a special type of natural languages, just like any other natural language and even more than others, does not have degrees of certainty, precision level, and transparency that is found in symbolic and formal languages that logicians have used it in order to explain relations in context of mathematics, logics, and modern physics based on formal rationalism. However, international law faces a more difficult test that recognizes dialogism, multiplicity of readings, and diversity of meanings, it gets degraded through the suppressive language of arrogant speakers}, keywords = {Legal Language,Analytic and Synthetic Propositions,dialogism,Communicative Rationality,Meaning,text,explanation,Monologue,Polyphony Test}, title_fa = {زبان حقوق بین‌الملل؛ در بوته آزمون تک صدایی یا چند صدایی}, abstract_fa = {مواجهه حقوقدان، همانند برخورد زبان شناس، ادیب، فیلسوف و منطقدان با زبان نیست. با این حال محدودیت ها و ابهام های زبان طبیعی درصورت بندی مفاهیم حقوقی و تبیین واقعیت ها، رمز گشایی از متن ها و فهم عقلانیت حاکم بر ارزش های سیستم حقوقی بین المللی باعث می شود حقوقدان فراتر از مرزهای واقعی دانش حقوق و در محدوده ای بین منطق، زبان شناسی و فلسفه تحلیلی زبانی به تدارک نظریه ای مناسب مفاهیم، گزاره ها، متن ها، نرم ها، مدل های عقلانیت و نظریه های حقوقی پرداخته و اهتمام خود را صرف بازشناسی ماهیت، نوع  و دلالت های منطقی آنها نماید. آنچه دشواری تدارک چنین نظریه ای را دوچندان می سازد خصلت دیالکتیک زبان حقوقی است، به این معنا که زبان حقوقی  هم باید برای توصیف بی پیرایه و دقیق واقعیت ها و امور اعتباری  حیات جمعی، واجد ظرفیت بیانگری، معناکاوی و رمزگشایی از متن های متین حقوقی باشد و درعین حال قابلیت بازنمایی و تدوین روشمند ارزش ها و الزام های حقوقی و قانونی را نیز دارا باشد. زبان حقوقی نوع خاصی از زبان های طبیعی به شمار می رود، درست مشابه هر زبان طبیعی دیگرو حتی افزون بر آن، فاقد درجات یقین، سطح دقت و شفافیت است که صرفا از زبان های صوری و نمادین ساخته است که منطق دانان آن را به منظور تبیین دقیق روابط ونسب موجود معرفتی در حوزه ریاضیات، منطق و فیزیک نوین بر پایه عقلانیت صوری به کاربسته اند. با این همه چالش، حقوق بین الملل، با آزمون دشوارتری مواجه است که چند صدایی و تکثر خوانش ها و تنوع معناها را به رسمیت بشناسد و یا اینکه در چنبره قدرت، به زبان  سرکوب سوژه های سخن گو و خود رای تنزل یابد.   }, keywords_fa = {زبان حقوقی,گزاره تحلیلی و ترکیبی,چند صدایی,معنا,متن,تاویل و تبیین,بشریت}, url = {http://www.isjq.ir/article_89543.html}, eprint = {http://www.isjq.ir/article_89543_38e37f0074e533a8f1c4ebadf621ef64.pdf} }
