Governments are obligated to fight violence against women, a gender-based discrimination in international human rights law. The European Convention on Human Rights has adopted rules to combat domestic violence against women. In addition to requiring governments to protect victims and punish perpetrators of violence, these commitments also eliminate the root causes of violence. The question concerns the representation of these provisions in the judicial precedent of the European Court of Human Rights. Therefore, this theoretical and descriptive-analytical study sought to explain the judicial precedent of the European Court of Human Rights in tackling domestic violence against women. Analysis of domestic violence against women within the framework of international human rights law in the judicial precedent of the European Court of Human Rights shows that these verdicts also consider this form of violence incompatible with European human rights laws and acknowledge that member states have practical commitments in this regard. }, keywords = {European Convention on Human Rights,Violence,Domestic Violence,European Court of Human Rights}, title_fa = {مقابله با خشونت خانگی علیه زنان با رویکردی بر رویه قضایی دادگاه حقوق بشر اروپا}, abstract_fa = {با توصیه عمومی شماره 19 کنوانسیون رفع هرگونه تبعیض علیه زنان، خشونت علیه زنان برای اولین بار به عنوان نوعی تبعیض بر اساس جنسیت پذیرفته و در سیستم رفع تبعیض علیه زنان ادغام شد، که قبلا به صراحت خشونت علیه زنان را مورد پذیرش قرار نمی‌داد. لاجرم دولت‌ها موظف به مبارزه با خشونت علیه زنان شده اند که به عنوان نوعی تبعیض بر اساس جنسیت در حقوق بین‌الملل حقوق بشر پذیرفته شده است. کنوانسیون اروپایی حقوق بشر نیز در همین راستا مقرراتی را در جهت مبارزه با خشونت خانگی علیه زنان وضع کرده است. مطابق با این تعهدات، دولت نه تنها موظف به حمایت از قربانیان خشونت و مجازات مرتکب است، بلکه باید ریشه‌ها و علل خشونت را نیز از بین ببرد. سوالی که در این رابطه مطرح می شود این است که این مقررات به چه نحوی در رسیدگی و آرای دیوان حقوق بشر اروپا نمود پیدا کرده است؟ بنابراین به صورت نظری و با روش توصیفی- تحلیلی به دنبال تبیین رویکرد رویه قضایی دادگاه حقوق بشر اروپا در خصوص مقابله با خشونت خانگی علیه زنان هستیم. وقتی خشونت خانگی علیه زنان در چارچوب حقوق بین‌الملل حقوق بشر در تصمیمات دادگاه حقوق بشر اروپا مورد تحلیل قرار می‌گیرد، مشاهده می‌شود که آرای دادگاه حقوق بشر اروپا نیز این شکل از خشونت را با احکام حقوق بشر اروپایی ناسازگار می‌داند و می‌پذیرد که دولت‌های عضو تعهدات عملی در این زمینه داشته باشند.}, keywords_fa = {کنوانسیون اروپایی حقوق بشر,خشونت,خشونت خانگی,دیوان حقوق بشر اروپا}, url = {http://www.isjq.ir/article_160358.html}, eprint = {http://www.isjq.ir/article_160358_fc8e3f1b68667438d99006ecc89c7f36.pdf} }
