مواجهه مصونیت مقامات عالی‌ترین دولتی و مسئولیت کیفری ناشی از ارتکاب جرایم بین‌المللی

چکیده

قرن ها مصونیت دولتها و مقامات آنها به صورت مطلق بوده و شامل تمامی مقامات عالی رتبه و همه اعمال آنها می شد. در نیمه قرن بیستم این نظریه که نبا ی د به مقامات عالی رتبه دولتی اجازه داد برخوردار از وضع یتی خاص باشند، مطرح شد دکترین مصونیت محدود حامی این بود ک ه مقامات عا لی رتبه به هنگام ارتکاب جنایات بین المللی، نزد محاکم بین المللی مصونیت ندارند. در سالیان اخیر و باتوحه به اینکه بی کیفری تهدیدی علیه صلح و امنیت بین المللی می باشد، با افز ایش اعمال صلاحیت جهانی توسط برخی کشورها روبرو بودیم و بالتبع قابلیت اعمال صلاحیت کیفری خارجی که در مواردی در تعارض با اصل مصو نیت مقامات دولتی  قرار می گرفت . موضوعی که به بررسی آن خواهیم پرداخت. در این خصوص برخی معتقدند که با وجود خلاهایی حقوقی که امکان اعمال صلاحیت محاکم بین المللی نسبت به مقامات دولتی مرتکب جرایم بین المللی به نحو عملی ناممکن ساخته، برای پرکردن این خلاء، باید دامنه مصونیت را محدود نموده و امکان اعمال صلاحیت کیفری محاکم خارجی بر مقامات را پیش بینی نمود. در بررسی این موضوع که آیا در رویکرد حقوق بین الملل نسبت به مصونیت مقامات عالی رتبه دولتی در نزد محاکم دولتهای دیگر تغیی ری رخ داده است، باید به مهمترین دغدغه موجود یعنی تقابل مصونیت مقامات رسمی و قواعد آمره حقوق بین الملل پرداخت. پاسخ به این سئوال که آیا مقامات دولت ی متهم به ارتکاب برخی از جرایم بین المللی می شوند می توانند به مصونیت خود در نزد محا کم دولتها ی دیگر استناد کنند؟روشن کننده تحول یا ایستایی حقوق بین الملل در این زمینه است.

چکیده [English]

This article examines the extent to which state officials are subject to criminal jurisdiction in foreign domestic courts for international crimes. A concept of immunity for foreign state officials has existed since ancient times Such immunity constitutes customary international law and, when applicable, frees such individuals from the criminal jurisdiction of foreign nations. I consider the different types of immunity that international law accords to state officials, the reasons for the conferment of this immunity and whether they apply in cases in which it is alleged that the official has committed an international crime. In light of the Judgments of ICJ and several cases before domestic courts around the world I try to find a proper respond for the following question, Does personal immunity continue to apply even where prosecution is sought for international crimes? Also I consider that instead of a single category of personal and functional immunity there are in fact two types of such immunity and that one type extends beyond senior officials such as the Head of State and Head of Government. However, I had a glance to the traditional arguments which have been put forward by scholars and courts in support of this view. This Article consists of three parts. Part I addresses immunity and state officials were accused of committing international crimes Part II explores outlawed State Officials‘ defense of immunity for international crimes and in the final section, conclusion, Dialectic between tow Doctrine, one of supports for immunity of senior officials absolutely and another Doctrine alleges outlawed State Officials‘ defense of immunity for international crimes.
