جایگاه کشمکش‌ها، انقلاب‌ها و جنگ‌ها در تکامل مفهوم حقوق بشر

چکیده

در حال حاضر منشاء مفهومی که به عنوان حقوق بشر شناخته می‌شود ریشه در دوران باستان دارد و قدمت آن به دوران اهلی شدن و تشکیل جوامع اولیه بشری بر می‌گرد. با این حال آنچه که در آن شکی وجود ندارد این است که انسان همواره نسبت به قوانین ظالمانه و ستمکارانه‌ای که برای مثال بر دهقانان روا می‌رفته از خود عکس العمل نشان داده است. شورش گروه‌های اقلیت بر علیه ظلم و قوانین استبدادی انگلستان که منجر به جنگ بر سر قانون اساسی در سال 1688 در آن کشور شد و یا جنگ برای استقلال در آمریکا در سال 1775، انقلاب فرانسه، جنگ‌های اول و دوم جهانی، انقلاب اسلامی ایران در سال 1979 و شروع بهار بی پایان عربی در خاورمیانه. آثار متزلزل این مواجهه، تصویب قوانینی را در پی داشته که اذعان بر این موضوع دارد که حقوق بیشتری به افراد واگذار شده است همچون اعلامیه استقلال،درونی‌سازی نگرانی برای حقوق بشر و بسیاری از مزایای تاریخی دیگر. بنابراین، در این مقاله ما به بررسی نقش این منازعات در بستر تاریخی تکامل مفهوم حقوق بشر خواهیم پرداخت. در اینجا با بررسی بحران کنونی در خاورمیانه  به این موضوع می‌پردازیم که آیا سقوط قوانین ظالمانه جهان عرب به معنای دستیابی شهروندان آن کشورها به قوانین مناسب و قابل احترام است؟

چکیده [English]

This paper deals essentially with the historical evolution of the concept of human rights and the progressive and pragmatic development of human rights precepts, crystallizing into the present body of human rights law. Our focus is on the place of conflict, revolution and war in this seemingly endless evolution of the concepts of human rights.
