بررسی نقش برنامه جامع اقدام مشترک در عدم اشاعه سلاح‌های کشتار جمعی در حقوق بین‌الملل

چکیده

سلاح‌های کشتار جمعی و آثار مخرب آن‌ها، همواره مورد توجه حقوقدانان در راستای ایجاد موانع حقوقی عدم اشاعه آن‌ها بوده است. چرا که پیامدهای فراوان این سلاح‌ها در جامعه جهانی از هیچ‌ کس پوشیده نیست. مقاله حاضر ضمن پرداختن به ماهیت توافقنامه بین‌المللی «برنامه جامع اقدام مشترک» موسوم به «برجام»، در صدد بررسی نقش عدم اشاعه سلاح‌های کشتار جمعی در حقوق بین‌الملل است. در این مقاله پس از بسط فضای مفهومی «برجام»، به اهمیت و نقش آن در عدم اشاعه سلاح‌های کشتار جمعی مورد بررسی قرار می‌گیرد. این، مقاله درصدد پاسخ به این پرسش است که برجام از چه طریقی می‌تواند بر عدم اشاعه سلاح‌های کشتار جمعی در حقوق بین‌الملل تأثیرگذار باشد؟ روش تحقیق مورد استفاده در این مقاله، توصیفی- تحلیلی است و گردآوری اطلاعات به ‌صورت کتابخانه‌ای صورت پذیرفته است. با توجه به فقدان تعدد کافی در پژوهش‌های انجام ‌شده مرتبط با موضوع «برجام» و نیز نظر به تأثیر «برجام» بر حقوق بین‌الملل حاکم بر عدم اشاعه سلاح‌های کشتار جمعی، و اینکه پژوهش حاضر با هدف تدوین و احصاء پیامدهای «برجام» بر اشاعه سلاح‌های کشتار جمعی، از نگاه راهبردی به متن توافق و نه محتوای توافق صورت پذیرفته، نتیجه کلی مقاله نشان می‌دهد که «برجام» از طریق تعهد و عمل به پروتکل الحاقی و پادمان آژانس بین‌المللی انرژی هسته‌ای و یادمان‌ها و اقدامات شفاف‌سازی‌شده مطرح در متن توافقنامه وین، از طریق کاهش رقابت تسلیحاتی و منع گسترش سلاح‌های هسته‌ای بر حقوق بین‌الملل حاکم بر عدم اشاعه سلاح‌های کشتار جمعی تأثیر می‌گذارد.

Weapons of mass destruction and their destructive effects have always been the focus of lawyers' efforts to create legal barriers to non-proliferation, as the consequences of these weapons are far from universal in the international community. This article, while addressing the nature of the international agreement of the Joint Comprehensive Plan of Action, which is called the "JCPOA", (as is called "Barjam" in Persian) seeks to examine the role of non-proliferation of WMDs in international law. In this paper, after expanding the conceptual space of the "JCPOA ", its importance and role in the non-proliferation of WMDs are discussed. The research method used in this article is descriptive-analytical and data collection has been done in the form of libraries. The findings of this study suggest that JCPOA, through its commitment to and implementation of the International Atomic Energy Agency's Additional Protocol and Safeguards, and the memoranda and transparency measures set out in the text of the Vienna Agreement, reduce international arms competition and non-proliferation. The ruling affects the non-proliferation of weapons of mass destruction.
