However, at the same time, the notion of the responsibility to protect (R2P) and transitional justice in practice have cast their specter over countries’ internal developments, misconduct, and human rights violations, holding them accountable  to domestic and international laws. These conflicting trajectories have come to a head during and in the aftermath of the 2011 Arab uprisings.  Charged with human rights violations, the ruling elites of Libya, Tunisia, and Egypt faced trials—both locally and internationally by the International Criminal Court. The UN Security Council authorized applying R2P to protect Libyan people and International Criminal Court issued the arrest warrants against Libya's Muammar Gaddafi, Saif al-Islam Gaddafi, and Abdullah Gaddafi. In Tunisia, an absentee trial for the deposed President Zine El Abidine Ben Ali was held.  In Egypt, however, the trial of Hosni Mubarak and those associated with his regime bypassed the so-called transitional justice model, while following the all too familiar pathway to promoting stability under the guise of national reconciliation. This paper’s central thrust is that political interests of the new rulers of Egypt, most notably the Supreme Council of Armed Forces (SCAF), the Muslim Brotherhood, and the military-backed interim government have turned the accepted and modern notion of transitional justice process on its head, while pursuing instead an authoritarian and managed judicial process in the name of state sovereignty and national stability.  }, keywords = {Transitional Justice,Egypt,Regime change,human rights violations,Impunity}, title_fa = {چالش‏های عدالت انتقالی با اقتدارگرایی در مصر پسامبارک؛ ارزیابی نقش نظام قضایی در ایجاد حکمرانی خوب}, abstract_fa = {دو روند موازی اما متضاد برای توصیف دهه‌های اول قرن 21 وجود دارد. از یک طرف؛ اصول سنتی حقوق بین‏الملل که در منشور ملل متحد به آنها اشاره شد نظیر اصول حاکمیت دولت‏ها، عدم مداخله در امور داخلی کشورها و همچنین اصل مصونیت مقامات دولتی در دهه نخست قرن 21 کارکرد خود را از دست داده و دچار تحول معنایی شدند. در مقابل؛ بعد اخلاقی حاکمیت دولت‏ها از اهمیت زیادی برخوردار شده و امروز دولت‌ها حفاظت از حاکمیت داخلی را از طریق ارتقای حقوق بشر مورد توجه قرار می‌دهند. مطرح شدن مفاهیم مهمی نظیر اصل مسئولیت حمایت و عدالت انتقالی در عمل به این معنا است که تحولات داخلی کشورها و رفتارهای غیرحقوقی و نقض حقوق بشر توسط دولت‏ها، واکنش‏های داخلی و بین‏المللی را به دنبال خواهد داشت. این اتفاق آشکارا در تحولاتی که جهان عرب از سال 2011 به بعد تجربه کرده است، رخ داد. حاکمان سه کشور عربی لیبی، تونس و مصر که در دوران قدرت خود به اشکال مختلف مرتکب نقض حقوق بشر شدند، پس از برکناری از قدرت در معرض محاکمه قرار گرفتند. با این حال، محاکمه مقامات رژیم سابق مصر فرآیند متفاوتی را از لیبی و تونس طی کرد و در واقع، عدالت انتقالی در این کشور به شکل ناقص و مهندسی شده و بدون اینکه منجر به اجرای عدالت شود، به اجرا در آمد. پرسش کلیدی این مقاله این است که چرا عدالت انتقالی در مصر به اجرای عدالت علیه مقامات سابق منجر نشده است؟ فرضیه اصلی این مقاله نیز این است که برتری یافتن منافع سیاسی حاکمان جدید مصر اعم از شورای نظامیان، دولت اخوانی و دولت موقت تحت حمایت نظامیان، سبب تبدیل فرآیند اعمال عدالت انتقالی درباره مقامات رژیم گذشته به عدالت هدایت شده گردیده است. }, keywords_fa = {عدالت انتقالی,مصر,تغییر رژیم,نقض حقوق بشر,معافیت از مجازات}, url = {http://www.isjq.ir/article_89795.html}, eprint = {http://www.isjq.ir/article_89795_f94a9fe72f5563d65cf42363ba17f825.pdf} }
